My Approach to Mediation

I adopt a pragmatic approach based on my own extensive experience as senior counsel in civil cases for over 20 years and my substantial experience as a mediator. My focus is on securing a successful resolution for the parties, and my success rate in securing solutions as a mediator is around 90%. My approach to mediation involves acknowledging the commercial realities and emphasising communication skills, particularly the ability to listen and identify routes of progress. My aim is that the parties find the experience to be productive and constructive, and I have received feedback to that effect.

My Mediation Training & Experience

I am accredited mediator having successfully undertaken training at the London School of Mediation in July 2016, to supplement my existing mediation experience. I have given talks to various professional bodies and firms on mediation, and ADR more generally.

I have substantial mediation experience in a range of practice areas with a particular emphasis on commercial mediation. In the past five years, I have acted as mediator in over 200 cases. In addition I have extensive experience as an advocate for parties in the mediation process which gives me a useful insight into the qualities needed to be a successful mediator.

I have given talks on mediation and on alternative dispute resolution to professional bodies and to various firms.

I was selected to Chair the Sub Committee on Mediation for the Civil Justice Review undertaken by Lord Justice Gillen.

I mediate in various practice areas such as banking, professional negligence, renewable energy, land, employment, housing, probate, public law, and sport. In reality, mediations often straddle these categories.

I have mediated before legal proceedings have issued, and conversely, while litigation is ongoing, up to trial.  I have been involved in many multi-party mediations, including those with 8 or more parties, arising out of high value construction disputes.

My Legal Background

With over 40 years experience as a practising barrister in civil litigation, in excess of half of that time has been as Senior Counsel. I have held a range of positions including:

Outside of my professional life I am an enthusiastic sports participant! I have been chair and captain of various sporting organisations including:

Coach & Manager at Aquinas F.C. and Rosario F.C.
Marathon runner for a range of charities

I am also a committed supporter of the Bar Charity Committee and contribute to its efforts for the selected charity each year.
