My Approach to Mediation

Experience has shown that most people who encounter litigation would like an outcome, which avoids the uncertainty of trial. I seek to bring to bear over 35 years in practice of negotiating and distilling a case to the essential points. I favour a focused and time-limited mediation with a strong emphasis on achieving an outcome, which is both confidential and fair. A good relationship with both lawyers representing their clients and the parties themselves is often a critical factor in creating an appropriate space for compromise.

My Mediation Training & Experience

My training was provided by the Institute of Professional Legal Studies in Civil & Commercial Mediation Training between September-November 2014.

I have attended numerous seminars and also attend events where CPD points are accredited. Additionally, I carry out private study to keep up to date with statutory legislation.

I have been an MIB Arbitrator since 2006 and have arbitrated in 94 cases and conducted 10 appeals. I have also additional arbitration experience in commercial and construction cases. I am also an independent assessor in relation to compensation under the Criminal Justice Act 1988.

Since November 2014, I have mediated 59 commercial mediations, including construction and partnership disputes, the interpretation of commercial agreements, employment cases, professional negligence claims and disagreements over land. In addition, I have also represented a large number of clients at mediations and arbitrations.

A substantial majority of the mediations with which I have been involved have resolved.

I am a former Chairman of the Bar Mediation and Arbitration Services Committee.

My Legal Background

I was called to the Bar of Northern Ireland in 1982 and to the Inner Bar in 2006. I have an extensive commercial and chancery practice, specialising in professional negligence, construction law, land law, general contract and education law.

I have been appointed to the following panels:-

The Crown Senior Panel.
Assets Recovery Agency Panel (subsequently SOCA).
Coroner’s Panel of Senior Counsel.
Departmental Legal Services Panel of Senior Counsel in respect of Property Law and Medical Negligence & General Litigation.
MIB arbitrator.
Northern Ireland Special Advocate Panel.
In 2018 I was appointed as Chairman of the Independent Neurology Inquiry arising out of the largest ever recall of patients in the Health Service in Northern Ireland.

My Other Interests

I am a former Chairman of Methodist College Belfast, having served on the Board of Governors for 13 years. I am currently a member of the Management Council for the Glencraig Community, which caters for children and adults with profound learning difficulties. I am a member and former Chairman of the Joint Independent Group for Study & Action (JIGSA), which is an independent political and economic think tank in Northern Ireland. I volunteer at the South Belfast Foodbank and completed, in 2018, a diploma in diaconal studies prior to ordination to the Permanent Diaconate in the Catholic Church.
