My Approach to Mediation

As a barrister, I have experience understanding the financial, time and emotional toll that disputes can have on parties. I appreciate motivations of parties in disputes. With this experience I help parties to find a mutual solution that satisfies the underlying motivations of both parties while avoiding the stresses of an ongoing dispute.

I adapt my style of mediation depending on the type of dispute and the type of parties involved. However, generally, my approach is facilitative. By listening to the concerns of parties and offering the parties the opportunity to express their concerns to the other side, assisting the parties to find their own resolution by understanding each other’s point of view. I take the time to understand the issues in a dispute and focus on ensuring that all parties in a dispute feel that they are given the appropriate forum to express their views.

I emphasise that mediation allows the parties to explore novel solutions that may not be available in a court environment and can often be conducive to an on-going relationship. I help parties to appreciate that a litigious process is uncertain and will ultimately leave at least one of the parties disappointed. I ensure that parties understand the benefit of owning their solution and finding a mutually beneficial solution. I emphasis that all mediations are confidential and parties can agree that any mediated solution remains private.

Prior to entering the Legal Profession, I operated a large company and understood the need to provide excellent quality service and value for money. Mediation allows for the preservation of relationships and often leads to a quicker and more cost effective solution to disputes when compared to litigation.

My Mediation Training & Experience

I became an accredited and certified mediator in January 2014 and trained with QuEST in association with the Bar Library (Northern Ireland).

I have experience mediating disputes involving Commercial, Land Law, Banking, Wills and Probate, Inheritance Disputes, Employment and Family Disputes. I also have experience advising in these areas as part of my role as a Barrister and have an acute understanding of the issues (both legal and strategic) that underpin disputes in these areas.

I have over 20 years experience as an executive in the Industry across the UK and Ireland. I sit as a Board Member in number of Non-Governmental Bodies and use the experience gained in Industry and Commerce to assist those in the Business Community. Each of these experiences helps me to understand the concerns of parties in Commercial and Corporate disputes.

I regularly present at continuing professional development courses and at business and commercial events regarding the benefits of mediation.

My Legal Background

I qualified as Barrister at the Northern Ireland Bar over 8 years ago and primarily practice Civil Law (with a focus on Commercial, Chancery, Land and Employment matters). I was recently called to the Bar in Dublin.

Before joining the Bar, I was a Solicitor in Private Practice and prior to that I was the Managing Director of a large company trading in Northern Ireland, Southern Ireland and the UK mainland.

My Other Interests

I am a keen swimmer, enjoy rugby, music and cinema. I previously coached mini rugby at Cooke Rugby Club and was a Governor at Victoria College, Belfast.

I hold a number of executive positions in Industry:

•Board Member and Chair of the Oversight and Governance Committee of the Agri-Food Bio Science Institute (Afbi)
•Board Member and Member of the Audit Committee of the Victims and Survivors Service.(VSS)
•Independent Panel Member of the Civil Legal Aid Panel at the Legal Services Agency.
